Terms of Use

Suteka Inc. d/b/a Suteka ("Suteka", "us", "our", or "we") offers the opportunity to purchase homeware DIY stickers through this website ("Site"). These Terms of Service ("Terms") govern your access and use of the Site and services available thereon, as available from time to time ("Services"). Our Privacy Notice, available at Suteka's Privacy Policy ("Privacy Notice") governs our collection, processing, and transfer of any Personal Data (as such term is defined in the Privacy Notice). "You" means an individual using the Site or the Services.

Please read these Terms carefully. By clicking on the button marked "I agree" you signify your assent to these Terms. Changes may be made to these Terms from time to time and your continued use of the Services following any changes to these Terms signifies your assent to the amended Terms. If you do not agree to any of these Terms, please do not click the button marked "I agree" and do not use the Services.

  1. Use of Services

    1. 1. Subject to these Terms, Suteka allows you to access and use the Site and Services on a non-exclusive basis. Through the Site, you will be able to purchase one or multiple DIY sticker kits, and have them delivered to you.

    2. 1. Use of and access to the Services is void where prohibited by law. You represent and warrant that (a) any and all information you submit is truthful and accurate; (b) you are 18 years of age or older and have the ability to form a binding contract; (c) your use of the Services does not violate any applicable law, regulation, or obligation you may have to a third party; and (e) you shall comply with applicable laws, regulations, guidelines, and these Terms throughout your use of the Site and/or Services.​

  2. Fees and Payment

    1. ​2. You agree to pay Suteka the amounts as specified on the Site in accordance with the DIY sticker kits you have purchased. Payments will be processed through the Wix payment gateway. You will be asked to provide customary billing information such as name, billing address, and credit card information to Wix. You hereby authorize the collection of such amounts by charging the credit card provided by Wix. Processing of payments by Wix is subject to Wix's terms and conditions and its Personal Data collection practices. Please review its terms and conditions and privacy policy before submitting payments.

    2. 2. Where applicable, taxes may also be charged. Except as expressly provided in these Terms, fees are non-refundable.

  3. Content

    1. 3. Certain types of content may be made available through the Services. "Content" as used in these Terms means, collectively, all content on or made available through the Services, including any images, photos, pictures, information, recommendations, and any modifications or derivatives of the foregoing.

    2. 3. SUTEKA DOES NOT ENDORSE ANY CONTENT, RECOMMENDATION, OR ADVICE EXPRESSED IN ANY CONTENT AND EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY IN CONNECTION WITH THE CONTENT, INCLUDING WITH REGARD TO ITS ACCURACY, USEFULNESS, SAFETY, OR APPROPRIATENESS.

  4. Use Restrictions: You may not do or attempt to do or facilitate a third party in doing any of the following: decipher, decompile, disassemble, or reverse-engineer any of the software and/or code, if and as applicable, used to provide the Site or Services without our prior written authorization, including framing or mirroring any part of the Site or Services; circumvent, disable, or otherwise interfere with security-related features of the Services or features that prevent or restrict use or copying of any Content; use the Site or Services or content thereon in connection with any commercial endeavors in any manner; use any robot, spider, site search or retrieval application, or any other manual or automatic device or process to retrieve, index, data-mine, or in any way reproduce or circumvent the navigational structure or presentation of the Site or Services; and/or use the Site or Services or content thereon in any manner not permitted by these Terms or applicable law.

  5. Intellectual Property: Suteka or its licensors, as the case may be, have all right, title, and interest in the Site, Services, and any Content thereon, including its overall appearance, text, graphics, graphics design, videos, and underlying source files, and all worldwide intellectual property rights, the trademarks, service marks, and logos contained therein, whether registered or unregistered. Except as expressly permitted herein, you may not copy, further develop, reproduce, republish, modify, alter download, post, broadcast, transmit or otherwise use the Content of the Site for any purpose. You will not remove, alter or conceal any copyright, trademark, service mark or other proprietary rights notices incorporated in the Site and/or Services, if any. All trademarks are trademarks or registered trademarks of their respective owners. Nothing in these Terms or the Site should be construed as granting you any right to use any trademark, service mark, logo, or trade name of Suteka or any third party.

  6. Disclaimers and Disclaimer of Warranty

    1. 6. All information and Content posted on the Site is for informational purposes only and Suteka provides no guarantees with respect thereto. Your use of the Site and/or Services and any products purchased through the Site is at your sole discretion and risk. The Services, Content thereon, are provided on an AS IS and AS AVAILABLE basis without warranties of any kind. We do not represent or warrant that Services will be of good quality or useful for your needs.

    2. 6. Although we try to reflect the colors, sizing, features, and specifications of the products accurately on the Site, we do not guarantee that the product you receive will be exactly as it appears on the Site. In addition, the electronic display of your device may not reflect the actual colors of the products. We do not guarantee that all items will be in stock and we reserve the right to discontinue offering any products or change pricing at any time at our sole discretion.

WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, RELATING TO THE SITE AND/OR SERVICES OR ANY CONTENT THEREON, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OF PROPRIETARY RIGHTS, COURSE OF DEALING OR COURSE OF PERFORMANCE. WE DISCLAIM ANY WARRANTIES, EXPRESS OR IMPLIED, (I) REGARDING THE SECURITY, ACCURACY, RELIABILITY, TIMELINESS AND PERFORMANCE OF THE SITE AND/OR SERVICES; (II) THAT THE SITE OR SERVICES WILL BE ERROR-FREE OR THAT ANY ERRORS WILL BE CORRECTED; (III) REGARDING THE ACCURACY, QUALITY, CURRENCY, COMPLETENESS OR USEFULNESS OF ANY INFORMATION PROVIDED ON THE SITE AND/OR SERVICES.

    4. 6. Durability Disclaimer

    5. 6. While we advertise our stickers as long-lasting, high quality and very durable, we do not guarantee their durability or lifespan. Factors beyond our control such as weather conditions, water temperature, cleaning detergent, application and removal methods, surface characteristics etc. can affect the durability of stickers. We do not warrant that stickers will maintain their appearance, adhesion or functionality for any specific period of time after purchase.

    6. 6. You can use stickers at your own risk. We shall not be liable for any damages caused due to early deterioration, loss of adhesion or product failure not resulting from a manufacturing defect. Any implied warranties relating to durability, such as warranties of merchantability or fitness for a particular purpose, are strictly limited according to this clause.

  7. ​ Limitation of Liability

Without derogating from any of the foregoing, we assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any Content or Services. We are not responsible for any problems or technical malfunction or failure of any telephone network or lines, computer online systems or equipment, servers or providers, software, failure due to technical problems or traffic congestion on the Internet or on the Services. In addition, we assume no responsibility for any incorrect data, including Personal Data provided by you or on your behalf and you hereby represent and warrant that you are solely responsible for any and all data provided to Suteka, including any incorrect data and you shall assume any and all liability for any consequences of provision of such incorrect data to us.

IN NO EVENT SHALL SUTEKA, ITS AFFILIATES OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, ASSIGNEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO THE QUALITY, ACCURACY, OR UTILITY OF THE INFORMATION PROVIDED OR ITEMS PURCHASED AS PART OF OR THROUGH THE SERVICES, WHETHER THE DAMAGES ARE FORESEEABLE AND WHETHER OR NOT SUTEKA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION AND IN NO EVENT SHALL OUR MAXIMUM CUMULATIVE LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US IN THE SIX MONTHS IMMEDIATELY PRECEDING THE DATE ON WHICH THE APPLICABLE CLAIM OR CAUSE OF ACTION AROSE, IF APPLICABLE. IF YOU HAVE NOT MADE ANY PAYMENTS TO SUTEKA, THEN SUTEKA'S LIABILITY TOWARD YOU SHALL NOT EXCEED US$50.

WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, RELATING TO THE SITE AND/OR SERVICES OR ANY CONTENT THEREON, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OF PROPRIETARY RIGHTS, COURSE OF DEALING OR COURSE OF PERFORMANCE UNLESS SUCH EXCLUSION IS PROHIBITED BY LAW. THIS LIMITATION OF LIABILITY SHALL NOT APPLY TO DAMAGES RESULTING FROM PERSONAL INJURIES CAUSED BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR AS OTHERWISE LIMITED BY LOCAL LAWS. WE DISCLAIM ANY WARRANTIES, EXPRESS OR IMPLIED, (I) REGARDING THE SECURITY, ACCURACY, RELIABILITY, TIMELINESS AND PERFORMANCE OF THE SITE AND/OR SERVICES; (II) THAT THE SITE OR SERVICES WILL BE ERROR-FREE OR THAT ANY ERRORS WILL BE CORRECTED; (III) REGARDING THE ACCURACY, QUALITY, CURRENCY, COMPLETENESS OR USEFULNESS OF ANY INFORMATION PROVIDED ON THE SITE AND/OR SERVICES.

  8. Product Use & Safety Policy

    1. 8.  Intended Usage. Our DIY stickers are intended solely for decoration of hard, non-porous surfaces in indoor, domestic settings. They are not intended for any other application, such as: Ingestion and application to human or animal skin. Do not use products for any purpose other than decorating. Stop usage immediately if adverse reactions occur.

    2. 8. Caution with Heat. Excessive heat exposure may damage stickers or surfaces. Use in accordance with the following guidelines:

      • Do not place stickers anywhere near open flames or other direct heat sources.

      • Apply and smooth out stickers before heat-setting, such as with a hair dryer.

      • Allow stickers to fully adhere before exposing to heat from direct sunlight or room temperature changes.

      • Do not touch the object or surface with bare hands following the heating process using home-oven or hairdryer.

    3. 8. Supervision of Children. Keep all products out of reach of young children due to the risk of choking or accidental ingestion. Ensure proper supervision of older children during the usage of tools or while stickers are drying. Do not rely on stickers as a child-proofing method.

    4. 8. Safe Tool Usage. Always follow safety instructions when using tools like scissors, oven, and hair dryers. Do not leave tools unattended or in reach of children. Wear protective garments as needed.

    5. 8. Adverse Reactions. Discontinue use immediately if adverse skin or other reactions occur upon contact with products. Seek medical attention promptly if symptoms persist.

    6. 8. Proper Disposal. Remove all waste, including the peeled off nylon layer and adhesive layer, according to local regulations for household trash. Avoid littering.

    7. Food Safety: Suteka stickers are designed with your safety in mind. Our sticker material meets FDA standards for lead and cadmium under CPG Sec. 545.400 and 545.450 for paper food contact materials, ensuring they are safe for use on food-contact surfaces. The Suteka stickers have been independently tested for lead and cadmium compliance with FDA regulations applicable to paper food contact materials, reflecting our commitment to safety and regulatory adherence. Customers are advised to follow the product description or instructions carefully to ensure safe and appropriate use on ceramic items intended for food contact. Compliance and safety are guaranteed when the product is applied correctly, adhering to our guidelines. However, Suteka cannot guarantee the same level of safety for products not set and heated as per our instructions.

  10. Indemnification. You agree to indemnify, defend, and hold harmless Suteka, its affiliates, and their respective employees, directors, officers, subcontractors, and agents, against any and all claims, damages, or costs, losses, liabilities, or expenses (including reasonable court costs and attorneys’ fees) that arise directly or indirectly from: breach of these Terms by you or anyone using your account and/or computer and/or mobile device (whether authorized or unauthorized); any claim, loss or damage experienced from your use or attempted use of (or inability to use) the Site or Services; your violation of any law or regulation or any of your obligations, representations, or warranties hereunder including but not limited to breach of any privacy and/or data protection laws and regulations to which you are subject; your infringement of any right of any third party; and any other matter for which you are responsible hereunder or under applicable law.

  11. Miscellaneous. These Terms shall be governed by the laws applicable to agreements made and entirely performed therein, without regard to conflicts of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in the jurisdiction deemed appropriate by Suteka, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein. In the event that any provision of these Terms is held to be unenforceable, such provision shall be replaced with an enforceable provision which most closely achieves the effect of the original provision, and the remaining terms of these Terms shall remain in full force and effect. Nothing in these Terms creates any agency, employment, joint venture, or partnership relationship between you and Suteka.
